Terms & Conditions of Ticket Purchase, Entry, and Liability

PLEASE READ CAREFULLY
THESE TERMS AND CONDITIONS CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING YOUR WAIVER OF LIABILITY AND ASSUMPTION OF RISK RELATING TO EXPOSURE TO COVID-19 OR ANY OTHER COMMUNICABLE OR INFECTIOUS DISEASE, YOUR WAIVER OF CLASS ACTION RIGHTS, AND YOUR AGREEMENT TO BINDING ARBITRATION.
BY PURCHASING A TICKET OR ENTERING THE PREMISES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.
I. Ticket Policy and Admission
- All Sales Final:
All ticket sales are final. There are no refunds, exchanges, or credits for any reason, including but not limited to illness, weather, transportation delays, scheduling conflicts, or dissatisfaction with the event experience. - One-Time Change Policy:
Guests may change their ticket one (1) time only to another available date or time, subject to availability and system limitations of our third-party ticketing platform (TicketSauce).
- If the new date/time costs more, you must pay the difference.
- If it costs less, no refund or credit will be given.
- Once changed, the ticket cannot be changed again or refunded for any reason.
- Admission:
- Each ticket admits one (1) person unless otherwise specified.
- A valid, scannable ticket and government-issued photo ID matching the ticket name are required.
- The Organizer may refuse or revoke entry at its sole discretion for reasons including but not limited to intoxication, disorderly behavior, violation of law, or failure to comply with venue policies.
- Re-entry is not permitted. Denial of entry or removal from the venue does not entitle the guest to a refund or credit.
- Age Policy:
- Frosty’s Christmas Bar Houston is all ages before 7:00 PM and 21+ after 7:00 PM.
- Guests under 21 must exit the premises by 7:00 PM.
- After 7:00 PM, valid government-issued photo ID showing age 21+ is required for entry.
- Refunds will not be provided for failure to comply with age restrictions.
II. Assumption of Risk and Waiver of Liability
(including COVID-19 and Infectious Disease)
- Assumption of Risk:
You acknowledge that attendance at public events carries inherent risks of exposure to COVID-19 (including variants), SARS-CoV-2, and other communicable or infectious diseases, which may result in illness, injury, or death. These risks cannot be entirely eliminated.
By attending Frosty’s Christmas Bar Houston, you voluntarily assume all risks associated with such exposure or transmission, whether caused by the negligence or otherwise of 2106 N Dallas Street LLC or its affiliates. You understand that your attendance is entirely voluntary.
- Waiver and Release:
On behalf of yourself and your heirs, executors, administrators, and assigns, you hereby waive, release, and discharge 2106 N Dallas Street LLC, Frosty’s Christmas Bar Houston, and their owners, officers, employees, affiliates, contractors, agents, successors, and insurers (collectively, the “Released Parties”) from any and all claims, demands, damages, or causes of action arising from or related to exposure to COVID-19 or any other communicable or infectious disease during or after your attendance, to the fullest extent permitted by Texas law. - Acknowledgment for Other Guests:
If you purchase or provide tickets for others, you represent that all such individuals have read and agreed to these Terms and voluntarily assume all risks described herein. - Indemnification:
You agree to indemnify and hold harmless the Released Parties from and against any and all claims, liabilities, damages, or expenses (including attorneys’ fees) arising from or related to your conduct, attendance, or violation of these Terms.
III. Health and Safety Compliance
- Guests must comply with all health and safety measures imposed by the venue, the City of Houston, Harris County, and the State of Texas.
- The Organizer reserves the right to refuse entry or remove guests for noncompliance, without refund.
- You understand that health policies may change and that continued compliance is a condition of entry.
IV. Guest Conduct and Removal
Guests must act responsibly and respectfully toward staff and other patrons. The Organizer reserves the right to deny admission or remove anyone whose behavior is unlawful, disruptive, or dangerous, including but not limited to:
- Excessive intoxication or substance use;
- Harassment, discrimination, or threats;
- Vandalism, theft, or damage to property; or
- Any violation of law or venue policy.
Guests removed from the premises will not receive refunds or credits.
V. Limitation of Liability
To the fullest extent allowed by law, the Released Parties shall not be liable for any indirect, consequential, incidental, or punitive damages arising out of your attendance or participation in the event, even if advised of the possibility of such damages.
VI. Binding Arbitration and Class Action Waiver
- Agreement to Arbitrate:
Any dispute, claim, or controversy arising out of or relating to these Terms, the purchase or use of tickets, or attendance at Frosty’s Christmas Bar Houston shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
Both parties waive the right to a trial by jury.
- Class Action Waiver:
You agree to bring any claims in your individual capacity only and not as a class member or representative in any class, collective, or consolidated action. - Location and Governing Law:
Unless otherwise agreed, arbitration shall be held in Harris County, Texas, and governed by the laws of the State of Texas and the Federal Arbitration Act (9 U.S.C. § 1 et seq.). - Informal Resolution Requirement:
Before filing for arbitration, you agree to provide written notice of dispute to:

Both parties will attempt in good faith to resolve the dispute informally within sixty (60) days.
VII. Governing Law and Venue
These Terms are governed by the laws of the State of Texas and the City of Houston. If arbitration is not elected, any disputes shall be brought exclusively in the state or federal courts located in Harris County, Texas.
VIII. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
IX. Entire Agreement
These Terms constitute the entire agreement between you and 2106 N Dallas Street LLC regarding the purchase and use of tickets for Frosty’s Christmas Bar Houston and supersede all prior agreements, statements, or representations.
X. Acknowledgment
By completing your ticket purchase or entering the venue, you confirm that you have read, understood, and agree to these Terms and Conditions, including the waiver of liability, assumption of risk, class-action waiver, and binding arbitration agreement.
